Article 1 — Purpose and acceptance
These terms of use (the “Terms”) govern access to and use of the Lectune service, published by SAS QR Développement (see the legal notice), on the lectune.fr website and in the Lectune Android app.
Creating an account, including with Google, constitutes unreserved acceptance of these Terms. Merely accessing the service without an account (search, listening to free books) also constitutes acceptance of the rules of use that apply to it. The purchase of credits is also governed by the terms of sale.
Article 2 — Definitions
- Service: the lectune.fr website, the Lectune Android app and the API that powers them.
- User: any person who accesses the Service, with or without an account.
- Account: the User's personal space, created with an e-mail address and a password or with Google.
- Soundtrack: the instrumental music composed by the Service for a book, organised in four movements.
- Credit: the unit used to set a book to music (see article 6 and the terms of sale).
- Free book: a book whose soundtrack Lectune offers to everyone, without account or credit.
Article 3 — The service
Lectune composes an original instrumental soundtrack for a book chosen by the User. A language model (Mistral AI, or Google Gemini as a fallback) writes a musical description (genre, mood, tempo, instruments) from the book's public metadata — title, author, subjects, summary — taken from Open Library; a music model (Google Lyria) then composes four movements. The player crossfades them, without audible looping, with ambient sounds and a sleep timer. Soundtracks are played within the Service (website and apps); they cannot be downloaded.
AI-generated content. No excerpt of the book's text and no existing musical work is used or reproduced. The soundtrack is a free artistic interpretation, generated automatically: it may not match the User's own idea of the book and may contain imperfections. It is presented in the Service as AI-generated; music produced by Google Lyria may carry an imperceptible digital watermark (SynthID).
Shared soundtracks. A soundtrack composed for a book may be offered, identically and without a new composition, to other readers who choose the same book. Lectune may also select free books, whose soundtrack anyone can listen to.
Article 4 — Access to the service
Without an account, the User can search for books and listen to free books. With an account whose e-mail address is verified, they can also set books to music, access their library and buy credits.
The Service is intended for people aged at least 15. Below that age, creating an account requires the consent of the holder(s) of parental authority. Any purchase by a minor requires the authorisation of their legal guardian.
Equipment, Internet access and related costs are borne by the User.
Article 5 — Account
An account is created with an e-mail address and a password, or with a Google account. The User provides an accurate address that they own. Verifying the e-mail address, through the link sent at sign-up, is required to set a book to music or buy credits; an account created with Google is verified automatically. If the address of an existing account is used to sign in with Google, the two are linked.
Each person may hold only one account. The User keeps their credentials confidential, remains responsible for the use of their account and notifies us without delay of any unauthorised use. A forgotten password can be reset by e-mail.
Article 6 — Credits and referrals
Setting a book to music costs 1 credit, whether it is a new composition or access to a soundtrack already composed; listening is then unlimited for as long as the account exists. Free books use no credit. The purchase, validity and conditions of credits are governed by the terms of sale.
Welcome credits. When an account is created, once its e-mail address is verified (or right away when signing up with Google), the User receives 3 free credits, without any purchase. These credits are granted only once per e-mail address (including its variants, even after an account has been deleted), only once per device, and within a limited number of sign-ups per IP address over 30 days.
Referrals. Each User has an invitation link (lectune.fr/?ref=CODE). When the invited person creates an account with this link or code and verifies their e-mail address (or signs up with Google), they receive 3 credits and the referrer 3 credits, without any purchase, on top of any welcome credits. To prevent abuse, no reward is granted:
- more than once for the same e-mail address, including its variants;
- more than once for the same device, or for a sign-up made from the referrer's device;
- for a sign-up made from the referrer's sign-up IP address;
- when the referrer's account is suspended;
- beyond a limited number of rewards per IP address over 30 days;
- beyond 10 rewarded referrals per referrer over 30 days.
Credits offered (welcome credits, referrals, goodwill gestures) have no monetary value and can be neither exchanged nor refunded. Creating multiple accounts, fictitious referrals or any circumvention of these rules may lead to the cancellation of the credits concerned and the suspension of the accounts involved.
Article 7 — Licence to use the soundtracks
To the extent that rights exist in the soundtracks, SAS QR Développement grants the User, for each soundtrack they have access to, a personal, non-exclusive, non-transferable and non-commercial licence to listen to it in the Service, for strictly private use, for the lifetime of their account.
The following are prohibited, in particular, without prior written permission:
- selling, renting, making available or sharing the soundtracks;
- copying or recording the soundtracks outside the Service;
- any broadcast or communication to the public (public places, radio, streaming, social networks, videos, podcasts, etc.);
- any commercial or advertising use;
- using the soundtracks to train, evaluate or improve an artificial intelligence system;
- automated extraction of soundtracks or of data from the Service.
The User acknowledges that the same soundtrack may be offered to other readers of the same book and that SAS QR Développement remains free to exploit it.
Article 8 — Acceptable use
The User undertakes to use the Service fairly and lawfully. In particular, they shall not:
- circumvent the Service's technical measures (signed audio links, usage limits, access control);
- use robots, scripts or any automated means to access the Service or extract content from it;
- share, sell or transfer their account, or use a third party's account;
- undermine the security or operation of the Service (intrusion, overload, malicious code);
- defraud the credit or referral system.
Article 9 — Intellectual property
The Service, its trademark, logo, texts, interface and code are protected and belong to SAS QR Développement. No right other than those provided for in these Terms is granted to the User.
Book titles, author names, summaries and covers come from Open Library (Internet Archive) and remain the property of their owners; they are displayed only to identify the work. Lectune is not affiliated with any author or publisher.
Article 10 — Availability and changes to the service
The Service is in principle available at all times, subject to maintenance, outages and force majeure. It relies on technical providers (hosting, artificial intelligence models, payment) whose unavailability may delay or prevent a composition. To preserve the quality of service, the number of compositions may be temporarily limited.
SAS QR Développement may change the Service and add, modify or remove features. A composition that fails for good results in the automatic return of the credit used.
Article 11 — Liability
SAS QR Développement uses reasonable means to ensure the proper operation of the Service. It cannot be held liable for indirect damage, for an interruption caused by a third party, the User or force majeure, or for the subjective appreciation of a soundtrack's artistic result.
The User is responsible for their use of the Service and of the soundtracks. Nothing in these Terms limits the rights a consumer User derives from mandatory legal provisions.
Article 12 — Suspension and account deletion
The User may delete their account at any time, free of charge, from the website, the app or by e-mail: the procedure and its effects are described on the Delete my account page. Any remaining credits are then lost and are not refunded.
In the event of a serious breach of these Terms (fraud, referral abuse, security breach, circumvention of technical measures), SAS QR Développement may suspend or delete the account concerned after informing the User, except in an emergency or where required by law. An account inactive for more than three years may be deleted after its holder has been informed.
Article 13 — Personal data
The processing of personal data, cookies and local storage are described in the privacy policy.
Article 14 — Changes to these terms
SAS QR Développement may amend these Terms. Substantial changes are notified to account holders by e-mail or within the Service at least 15 days before they take effect. A User who refuses them may delete their account; otherwise, continued use of the Service constitutes acceptance of the new Terms.
Article 15 — Governing law, mediation and disputes
Before any legal action, the customer is invited to contact customer service at contact@qr-developpement.fr to seek an amicable solution.
In accordance with Articles L611-1 et seq. and L612-1 of the French Consumer Code, if no amicable solution is found, a consumer customer may refer the dispute free of charge to a consumer mediator, within one year of their written complaint to us. The contact details of the consumer mediator on which QR Développement depends are provided on request at contact@qr-developpement.fr.
These terms are governed by French law. Failing an amicable solution, any dispute shall be brought before the competent French courts; a consumer customer may bring proceedings before the court of their place of residence at the time the contract was concluded or of the place where the event causing the damage occurred, and retains the protection of the mandatory provisions of the law of their country of residence.
